DISCIPLINARY COMPLAINT AGAINST PROSECUTOR IZET ODOBAŠIĆ

In connection with the latest information in the public concerning the work on the case of the Prosecutor’s Office of BiH regarding the events that took place in the area of Sanski Most in the course of 1992 and for the purpose of objectively informing the public, we inform you that the Chief Prosecutor of the Prosecutor’s Office of BiH filed a disciplinary complaint to the Office of the Disciplinary Prosecutor on 3 February 2026 against Prosecutor Izet Odobašić, because of the disciplinary violations of non-execution of the superior prosecutor’s instruction as prescribed by law and violation of the principles of the Prosecutor’s Code of Ethics, which have caused damage to the reputation and integrity of the judiciary.    
  • DISCIPLINARY COMPLAINT AGAINST PROSECUTOR IZET ODOBAŠIĆ

Namely, already on 26 March 2024 Prosecutor Odobašić was issued an instruction to complete the investigation in the above-mentioned case and make a prosecutorial decision by 1 December 2024. One year after this deadline, that is, on 2 December 2025 to be exact, he submitted a draft of the Order to conduct Investigation to the Office of the Chief Prosecutor, which was incomplete, unclear and completely contrary to the current practice of the Prosecutor’s Office of BiH and the Court of BiH, and which, for the most part, contained the text that was copied verbatim from other cases of the Prosecutor’s Office. Due to the stated reasons, and in accordance with the by-laws, this document was returned to him for revision and elimination of observed irregularities.

 

We note that the stated practice of giving guidelines and instructions to prosecutors in order to eliminate deficiencies is in accordance with the guidelines of the Supreme Court of BiH and is applied almost on a daily basis in the work of the Prosecutor’s Office. Dozens of instructions and guidelines were given in 2025 alone with the aim of eliminating observed deficiencies and preventing situations where indictments are repeatedly returned by the Court of BiH for their revision and finalisation or even rejected due to procedural deficiencies.

 

Instead of acting as per the received instructions and reviewing the document in question, the prosecutor ignored the legal instructions, went to the Office of the Chief Prosecutor on 30 December 2025 (less than two days before the end of the calendar year) and submitted the draft of the indictment, which contained the same deficiencies as the draft of the Order to Conduct Investigation, with the aim of presenting by 31 December that the case was completed in order to achieve the quota, because at that moment, for the year 2025, he had achieved the annual quota of only 9%.

 

Since the prosecutor did not act according to the instructions, the Head of the Special Department for War Crimes was ordered to schedule meetings with prosecutors in charge and other prosecutors in order to help Prosecutor Odobašić to complete the investigation in the said case and file an indictment.

 

However, aware that within two days, which were left until the end of 2025, he would not be able to correct the deficiencies, and consequently not even be positively evaluated for his work in that year, with the intention of justifying his inefficient activities with alleged prohibitions by the Chief Prosecutor, Prosecutor Odobašić publicly presented inaccurate and untrue information about the influence of the Chief Prosecutor on his work, thereby committing the above violations.

 

It is absolutely incorrect that the Chief Prosecutor forbade anyone to do anything, and especially forbid the filing of an indictment, because both the Chief Prosecutor and the management of the Special Department for War Crimes encourage and support prosecutors to achieve the best possible results, in accordance with professional norms and standards.

 

In order to complete the mentioned case properly, legally and efficiently, the Head of the Special Department for War Crimes was ordered to undertake the necessary activities in coordination with department heads and prosecutors who worked on similar and related cases, which he is currently doing, and the public will be informed of the results.
