INDICTMENT ISSUED FOR CRIMINAL OFFENSES OF PROVOKING ETHNIC, RACIAL AND RELIGIOUS HATRED, CONFLICTS AND INTOLERANCE AND THREATENING SECURITY

Prosecutor of the Prosecutor’s Office of BiH issued an indictment against: 
  • INDICTMENT ISSUED FOR CRIMINAL OFFENSES OF PROVOKING ETHNIC, RACIAL AND RELIGIOUS HATRED, CONFLICTS AND INTOLERANCE AND THREATENING SECURITY

-    Jasmin Mulahusić, born in 1976, residing in Luxembourg, citizen of Luxembourg and BiH.

The indictment lists  that, he  acted from the territory of the Grand Duchy of Luxembourg, with the intention of provoking hatred directed against a group or a member of a group in Bosnia and Herzegovina, on ethnic, religious and grounds of origin thus provoking and inciting conflict, ethnic and religious hatred and intolerance among the constituent peoples  of BiH and others in the period from 2021 to 2023 via the use of at least four profiles on social networks through which he sent insults, threats and humiliating edited photographs and used available internet space to insult and  endanger journalists and media representatives as well as other persons in other ways.

Evidence was gathered that the accused continuously published content about the people he was targeting by creating photomontages and creating untrue content about the people he wrote about, with the intention of causing them and their family members to feel threatened, insecure and afraid, which is exactly what happened.

During the aforementioned period the accused publicly called for the dismissal from jobs in the capital of BiH, the Federation of BiH, and in the institutions of BiH, of ethnic Croat and Serb people only on the basis of their origin, ethnicity or religious affiliation, by connecting them with the war events in Bosnia and Herzegovina; he acted in this way towards Bosniaks who do not have the same  radical views on political life, ethnicity and religion and severely insulted them on religious and ethnic grounds, classifying them in an insulting way as members of other constituent peoples in BiH, traitors and infidels, publicly calling his numerous followers to punish them by leaving comments  with extremely offensive and threatening content towards the targeted individuals.


The accused is charged with having committed the criminal offense of Provoking Ethnic, Racial and Religious Hatred, Conflicts and Intolerance under Article 145a of the Criminal Code of Bosnia and Herzegovina as well as criminal offense of Threatening Security under Article 183 of the Criminal Code of Federation BiH.

The prosecutor’s office will prove the allegations of the indictment by calling nine (9) witnesses, one expert and submitting dozens of material evidence, including evidence obtained through mutual legal assistance from other countries.


The indictment was forwarded to the Court of Bosnia and Herzegovina for confirmation.
