INDICTMENT ISSUED AGAINST BROTHERS, MATE (1969) AND BLAGO (1976) ŠIMIĆ

Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor's Office of BiH has issued an Indictment against the following persons:

- Mate Šimić aka ‘Dolkić’, born on 04 October 1969 in Ljubuški, resident of Grude, citizen of BiH and the Republic of Croatia, and

- Blago Šimić aka ‘Dolkić’, born on 05 September 1976 in Ljubuški, resident of Grude, citizen of BiH and the Republic of Croatia.

The accused persons are charged with the criminal offenses of Organized Crime, Illicit Trafficking in Narcotic Drugs and Illicit Possession of Weapons or Explosive Substances.

The Indictment alleges that, in the period from 2004 to 2007, after Mate Šimić had organized and managed a group for organized crime, which was joined by Blago Šimić and other persons from the territory of Grude Municipality known to them, on several occasions, these accused persons transported larger quantities of Marijuana- Skunk narcotic drug which was proclaimed a narcotic drug and which circulation is prohibited by law.

Mate and Blago Šimić obtained the above-mentioned drug in a manner and from persons known to them, and then they transported larger quantities of this narcotic drug in passenger vehicles from Bosnia and Herzegovina to the Republic of Croatia at locations where border crossing is prohibited. They transported the drug to Zagreb and Šibenik, where they would get money from persons known to them.

As further alleged in the Indictment, on 17 December 2012, 10.50 kilograms of Marijuana- Skunk narcotic drug were found in a house in Grude used by these accused persons, which these accused persons intended to sell to persons in the Republic of Croatia known to them for an agreed amount of money. On the same day, eleven sticks of explosive substances of Kamniktit and Vitezit were found in their house; the chemical structure of these substances contains Trinitrotoluol (TNT), Nitroglycerine (NG) and Ammonium Ion and the accused obtained them in an unauthorized manner as their procurement and possession of, and trade in, are prohibited by the applicable legal provisions.   

The accused Mate Šimić is charged with endangering security of Zoran Galić, Police Commissioner of the Western Herzegovina Canton, on 30 November 2011, in the territory of Grude Municipality, by calling Galić on his mobile phone and threatening him that, if he did not leave him alone, he would bring Wahhabis to rape his wife and children, whereas he would be tied up and forced to watch all that; Zoran Galić took all this very seriously as endangering of his personal security and security of his family members.

The Accused Mate Šimić is charged with the commission of the continued criminal offense of Organized Crime, as referred to in Article 250, Paragraph 3 of the BiH CC, in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs, as referred to in Article 195, Paragraph 1 of the BiH CC, as read with Article 54 of the BiH CC, criminal offense of Illicit Trafficking in Narcotic Drugs, as referred to in Article 195, Paragraph 1 of the BiH CC, as read with Article 29 of the BiH CC, criminal offense of Illicit Possession of Weapons or Explosive Substances, as referred to in Article 371, Paragraph 1 of the FBiH CC, as read with Article 31 of the FBiH CC, and the criminal offense of Endangering Security, as referred to in Article 183, Paragraph 1 of the FBiH CC.

The Accused Blago Šimić is charged with the commission of the continued criminal offense of Organized Crime, as referred to in Article 250, Paragraph 2 of the BiH CC, in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs, as referred to in Article 195, Paragraph 1 of the BiH CC, as read with Article 54 of the BiH CC, criminal offense of Illicit Trafficking in Narcotic Drugs, as referred to in Article 195, Paragraph 1 of the BiH CC as read with Article 29 of the BiH CC, as well as the criminal offense of Illicit Possession of Weapons or Explosive Substances, as referred to in Article 371, Paragraph 1 of the FBiH CC, as read with Article 31 of the FBiH CC. 

These accused persons are in custody.

The Indictment was forwarded to the Court of BiH for confirmation.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
