INDICTMENT ISSUED AGAINST FOUR PERSONS FOR INTERNATIONAL ILLICIT TRAFFICKING IN NARCOTIC DRUGS

Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor's Office of BiH issued an indictment against the following persons:

-        K.S. (1982) from Velika Kladuša, BiH citizen, currently in custody,

-        F.A. (1981) from Velika Kladuša, BiH citizen,

-        P. Dž. (1987) from Velika Kladuša, BiH citizen, and

-        K.Z. (1956) from Velika Kladuša, BiH citizen.

The accused K.S. is charged to have, in the period from September to December 2012, organized a group of people from Bosnia and Herzegovina and the Republic of Slovenia for the purpose of generating illicit gain. The group produced, sold and transported narcotic drug Cannabis sativa L, known as "Marijuana", which is declared a narcotic drug by regulation. The accused then sold the goods to his longtime collaborator from the Republic of Slovenia, as well as other persons from the European Union countries with whom he got in contact and who have ordered and purchased the narcotic drugs.

As alleged in the indictment, the accused F.A. and P. Dž. have become members of an organized group of people which engaged in production and trafficking of narcotic drugs for international sales, while the accused K.Z. served as a go-between in international sales.

Following the instructions of the accused K.S., who had obtained the equipment, installed the lab and thought them how to grow,  the other accused persons i.e. F.A. and P. Dž.. grew the drug in the family house of  P. Dž. Located in the Una-Sana Canton. During that time the accused K.S. was mostly in the Republic of Slovenia. Once the stems have grown and were ready for harvesting, drying and consumption, K.S. asked F.A. to bring the narcotic drug so that he can check the quality and ordered him to hand it over to K.Z. and then told her /K.Z/ to take the narcotic drug and pay them for the work performed. The accused K.Z. then handed the drugs to persons known to them in the city of Ljubljana, so that K.S. could transport and sell it to the aforementioned associate and other customers from European Union countries.

Second count of the indictment charges the accused K.S. to have engaged, in the same manner, in production of narcotics for the purpose of sale in the territory of the Republic of Slovenia as well. In fact, in the Republic of Slovenia he hired two associates to produce the narcotic drug "marijuana" for him which he then sold in the Republic of Slovenia to his associate and other customers from the Kingdom of the Netherlands.

The accused are charged with having committed International sale of large quantities of marijuana during the aforementioned period. Members of the Ministry of Interior of the Republic of Slovenia have, in a joint coordinated action with  members of the State Investigation and Protection Agency in BiH, conducted searches on several locations in both states discovering a laboratory for cultivation in Ljubljana as well as a large amount of the plant stalks as well as another laboratory for cultivation in Velika Kladuša with a significant number of stems of this plant. Due to previously described activities the accused are charged with having committed the following criminal offences:  K.S. is charged with the criminal offence of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 2 in conjunction with Paragraph 1 of the Criminal Code of Bosnia and Herzegovina in conjunction with the criminal offence of Unauthorized Production and Trafficking of Narcotic drugs under Article 238, Paragraph 1 of the Criminal Code of the Federation of Bosnia and Herzegovina, all in conjunction with Article 53  (Concurrence of Criminal Offences); the accused F.A. and P. DŽ. are charged with. the criminal offence of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 2 in conjunction with Paragraph 1 of the Criminal Code of Bosnia and Herzegovina in conjunction with Unauthorized Production and Trafficking of Narcotic Drugs under Article 238, Paragraph 1 of the Criminal Code of the Federation of Bosnia and Herzegovina; and the accused K.Z. is charged with the criminal offence of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 2 in conjunction with Paragraph 1 of the Criminal Code of Bosnia and Herzegovina.

The indictment was forwarded to the Court of BiH for confirmation.
