INDICTMENT ISSUED AGAINST PALE HANIFI (1979) FOR CUSTOMS FRAUD AMOUNTING TO ABOUT 211,000.00 BAM

Prosecutor of Department III within the Prosecutor's Office of BiH issued an indictment against  Pale HANIFI, born on April 10, 1979 in the village of Kadirli - Republic of  Turkey, residing in Sarajevo, a citizen of the Republic of Turkey.

The indictment of the Prosecutor's Office of BiH charges Pale HANIFI  to have, during the period from March 8, 2008 to December 8, 2009,  while working in the capacity of a responsible person in the company MEGACO d.o.o. (LLC) Tuzla,  filed false customs declaration and other documents to the customs authority in order to evade payment of customs duties and other taxes that are paid on the import of goods, and is thus charged with the criminal offense of Customs Fraud under Article 216, Paragraph 3 in conjunction with Paragraph 1 of the Criminal Code of BiH.

The accused is charged to have, during import of goods from the Republic of Ukraine, agreed with the sellers to issue dual invoices-bills that accompanied the export and import of goods to Bosnia and Herzegovina, in a way that the bills with the actual contracted prices of goods be used at export from the R Ukraine and transit to Bosnia and Herzegovina, while at the entrance to Bosnia and Herzegovina, other bills-invoices with reduced prices for the same quantity of goods be presented to the officials of the Indirect Taxation Authority.

As alleged in the indictment, the accused issued the disposition of import to authorized shipping company from Mostar to submit the invoices with reduced net value of goods during the import into Bosnia and Herzegovina i.e. the employees of his company in Tuzla were instructed to report the customs value in reduced prices.

The accused Pala Hanifa is charged to have committed seven criminal actions during several imports, in order to evade payment of duties, customs and value added tax in the amount of 211,594.83 BAM thus damaging the BiH budget for the same sum.

The indictment was forwarded to the Court of BiH for confirmation.
