TWO ACCUSED PERSONS CONCLUDED PLEA AGREEMENTS

Two persons accused of Illicit Trafficking in Narcotic Drugs have concluded Agreements on admission of guilt. The proposed sentences for the accused range from two to 4 years of imprisonment. The following accused persons entered into plea agreements with the Prosecutor of the Prosecutor's Office of BiH:

1.  Ganija KURTI, born on September 23, 1969 in Nikšić in Republic of Montenegro, residing in Podgorica - Republic of Montenegro, a citizen of Montenegro, charged with the criminal offence of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 2 of the CC BiH in conjunction with Paragraph 1 of the CC BiH. The prosecutor proposed that the accused Ganija KURTI be sentenced to four (4) year imprisonment by the Court of BiH.

2.  Mileta JESTROVIĆ, born on November 27, 1964 in Pljevlja – Republic of Montenegro where he resides, citizen of Montenegro, charged with the criminal offence of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 2 of the CC BiH in conjunction with Paragraph 1 of the CC BiH. The prosecutor proposed that the accused Mileta JESTROVIĆ, be sentenced to two (2) year imprisonment by the Court of BiH.

By virtue of the plea agreements the accused persons admitted committing the criminal offense they were charged with by the indictment of the Prosecutor's Office of BiH dated June 15, 2012.  They are charged to have,  as members of an organized group operating in the Foča area, transported 10 kg and 664, 5 grams of Marijuana from Montenegro to BiH across the border at a spot not designated for border crossing on March 20, 2012 for the purpose of its further illicit international sale.

The proposed sentences are in line with the roles of the accused persons in commission of the crimes listed in the indictment.

By virtue of the plea agreements the accused have pledged to testify before the Court of BiH when summoned by the Court of BiH.

With these agreements the accused confirm that they are aware of the content of the indictment issued by the Prosecutor's Office of BiH on June 15, 2012. They also confirm that the plea statements were given voluntarily, knowingly and with full understanding and undertake to reimburse the costs of the criminal proceedings in the amount that may eventually be determined by the Court of BiH.

Pursuant to this agreement the accused waived their rights to a trial and appeal to the criminal sanction that shall be rendered to them by the Court of BiH.

The agreements were submitted to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
