INDICTMENT ISSUED AGAINST ŠEFIKA OMANOVIĆ (1956)
03.04.2012. 15:02The indictment charges Šefika OMANOVIĆ that during the 2010 and 2011, as an owner of a stand - at the market in Velika Kladuša, she purchased CDs and DVDs from persons known to her who have engaged in illegal sale of pirated CDs and DVDs and then sold the purchased CDs and DVDs at her stand. She has put 4419 of recorded CDs, DVDs and PC games into circulation without permission and aware that those were illegal copies which is contrary to Article 34 of the Law on Copyright and Related Rights in BiH ("Official Gazette of BiH", No. 7 / 02).
As alleged in the indictment, during the search of her business premises, the above mentioned items were found and seized by authorized officials of the State Investigation and Protection Agency - SIPA, Regional Office Banja Luka.
The accused Šefika OMANOVIĆ has, in this manner, put copyrights into circulation without authorization of the author or another holder of copyright, and is thus charged to have committed the criminal offense of Impermissible Use of Copyright under Article 243, Paragraph 1 of the Criminal Code of BiH.
The indictment was forwarded to the Court of BiH for confirmation.
