AN OVERVIEW OF THE MAJOR ACTIVITIES FOR THE WEEK BETWEEN 29 SEPTEMBER AND 3 OCTOBER 2025

An overview of the major activities for the week between 29 September and 3 October 2025.  

 

INDICTMENT FILED FOR CRIMINAL OFFENCE OF TERRORISM

The Prosecutor’s Office of BiH filed an indictment against Armel Zalihić* aka “Zala”, born in 2003 in Konjic, citizen of Bosnia and Herzegovina. He is charged that on 26 March this year, with the intention of seriously intimidating the population and seriously destabilising the basic political, constitutional and social structures in Bosnia and Herzegovina, he publicly threatened via social media to carry out a terrorist act aimed at the mosque in Konjic, as well as to carry out an attack on life and physical integrity, and to cause great damage to public facilities that would endanger human lives. He is accused of threatening to commit a terrorist act, whereby he would commit the criminal offence of Terrorism set out in Article 201 (5) (i), of the Criminal Code of BiH, as read with items (a), (b) and (d) thereof, and all in conjunction with Article 201 (1) of the Criminal Code of BiH.



CUSTODY MOTION FOR PERSONS SUSPECTED OF HUMAN SMUGGLING

The Prosecutor’s Office of BiH submitted to the Court of BiH a custody motion for the suspect Mersudin Kurbegović*, born in 1997 in the Pljevlja, a citizen of Montenegro. The suspect was deprived of his liberty after he had attempted to smuggle 30 migrants, citizens of the Republic of China, through the territory of BiH into the Republic of Croatia by the freight motor vehicle with Montenegrin license plates that he operated. He is suspected of the criminal offence of human smuggling under Article 189 of the Criminal Code of BiH. The custody measure was proposed for the reasons described in Article 132 (1) (a) and (b) of the Criminal Procedure Code of BiH, that is, because of the risk of flight of the suspect who is a foreign citizen, as well as the risk that if he is at large, he could interfere with the investigation and influence witnesses or accomplices.



CUSTODY MOTION IN ORGANISED CRIME CASE


The Prosecutor’s Office of BiH sent a motion to the Court of BiH to impose the custody measure on the suspect Nenad Jovičić*, born in Sarajevo in 1987, citizen of BiH. The custody measure was proposed for the reasons described in Article 132 (1) (b) and (c) of the Criminal Procedure Code of BiH. The suspect was deprived of his liberty as part of an investigation into the installation of GPS devices under the cars of several people, including judicial officials. He is suspected of having committed the criminal offence of Organised crime (Article 250), in conjunction with the criminal offences of Obstruction of justice (Article 241) of the Criminal Code of BiH, Serious bodily injury under Article 172, Serious crimes against the general safety of people and property (Article 328) and Causing general danger (Article 323) under the Criminal Code of the Federation of BiH. The case involved the cooperation of several police agencies in BiH, including SIPA and the Sarajevo Canton MoI, the Federation Police Department support, cooperation with the Sarajevo Canton Cantonal Prosecutor’s Office, as well as international cooperation with EUROPOL and partner institutions of several countries in the region and the EU.



EXHUMATION CARRIED OUT IN PRIJEDOR


On 30 September this year, at the Hambarine-Luščani site, Prijedor municipality, an exhumation process was carried out and the incomplete remains of one person were found during it. The remains were transported to the Šejkovača Identification Centre in Sanski Most, for further forensic and medical processing and for the purpose of establishing the identity of the missing person through DNA analysis. The exhumation process was led by an investigator from the Special Department for War Crimes on the instructions of a prosecutor. A forensic pathologist, representatives of the Institute for Missing Persons (IMP) of BiH, as well as police officers of the Republika Srpska Ministry of the Interior, who secured the site, participated in the exhumation.



APPEAL FILED AGAINST JUDGMENT FOR WAR CRIMES IN ROGATICA


The Prosecutor’s Office of BiH filed on 30 September this year, within the legal deadline, an appeal with the Court of BiH against the first-instance judgment in the Zoran Nešković* et al. case. The appeal was filed with regard to the acquittal part of the judgment, which acquitted Zoran Nešković, Panto Pantović*, Slaviša Đerić*, Nenad Ujić* and Pero Despet* of the charges. The appeal was filed due to an incorrectly and incompletely established factual situation as set out in Article 299 (1) of the Criminal Procedure Code of BiH. Moreover, due to dissatisfaction with the amount of the imposed sentence, an appeal was filed in relation to the convicting part of the judgment for the accused Slaviša Đerić and Nenad Ujić, and regarding the decision on the criminal sanction set out in Article 300 (1) of the Criminal Procedure Code of BiH.
