CUSTODY PROPOSED FOR FOUR PERSONS SUSPECTED OF WAR CRIMES COMMITTED IN DRETELJ CAMP

Prosecutor of the Special Department for War Crimes of the BiH Prosecutor's Office has filed a motion with the Court of BiH proposing custody for the following suspects:

-  Srećko Herceg, born on 01 January 1968 in Ljubuški Municipality, resident of Ljubuški, citizen of both BiH and Republic of Croatia,

- Ivan Medić, born on 31 May 1952 in Ljubuški, resident of Ljubuški, citizen of both BiH and Republic of Croatia,

- Marina Grubišić-Fejzić, born on 24 August 1967 in Čapljina, resident of Ilidža Municipality, citizen of BiH, and

- Ivan Zelenika, aka “Zela“, born on 17 October 1953 in Široki Brijeg Municipality, resident of Mostar, citizen of both BiH and Republic of Croatia.

Prosecutor of the Special Department for War Crimes of the BiH Prosecutor's Office has filed a motion with the Court of BiH proposing custody for the aforementioned persons who are suspected of committing criminal offenses of Crimes against Humanity, as referred to in Article 172 of the Criminal Code of BiH, and War Crimes against Civilians, as referred to in Article 173 of the Criminal Code of BiH. 

All the aforementioned persons were deprived of liberty early in the morning of 22 February 2012, by officers of the State Investigation and Protection Agency - SIPA, because they have been suspected of War Crimes committed against persons of Serb ethnicity unlawfully detained in the Dretelj camp in Čapljina.

Inter alia, in May 1992, as camp commanders, guards or members of HOS formations, they have allegedly committed war crimes against Serb civilians from the territory of Čapljina and other places who have been kept unlawfully detained in the Dretelj camp under inhumane conditions; there, these victims have been subjected to mistreatment, torture, beatings, rape and sexual abuse of both female and male detainees, and they have also been tortured in especially degrading manner. Several persons died as a result of this mistreatment and beatings, and some of the detainees have been taken out of their cells and have not been found since.

The Prosecutor has proposed ordering custody for the aforementioned suspects for reasons as described in Article 132(1)(a) and (b) of the Criminal Procedure Code of BiH, that is, because he finds that circumstances exist that suggest a possibility of flight of these suspects and that, if these suspects are not in custody, they might influence witnesses, accessories or accomplices.  

The Prosecutor's Office of BiH has filed a motion to the Court of BiH proposing that, for these reasons, the suspects are ordered into 30- day custody.  

The decision on custody will be rendered by the Court of BiH.
