INDICTMENT FILED AGAINST SRPKO PUSTIVUK (1963)

The Prosecutor's Office of BiH filed an Indictment against Srpko Pustivuk who is charged with having committed the criminal offense of War Crimes against Civilians in violation of Article 173(1) of the Criminal Code of Bosnia and Herzegovina, in conjunction with Article 180(1) and Article 29 of the same Code.

The defendant Srpko Pustivuk a.k.a. „Srle“, born on 19 March 1963 in Visoko, citizen of BiH, is charged with having committed the criminal offense of War Crimes against Civilians in violation of Article 173(1) of the Criminal Code of Bosnia and Herzegovina. The defendant Srpko Pustivuk was arrested on 13 July 2010 in Bijeljina by the police officials of the State Investigation and Protection Agency – SIPA. He has been in custody since 14 July 2010.

The charge against the defendant is that during the war and armed conflict in Bosnia and Herzegovina between the Army of the Serb Republic of BiH on one side and the Army of Bosnia and Herzegovina on the other, in the wider Sarajevo area, during the months of May and June 1992, as a member of the police, specialist police officer at the Public Security Station Ilijaš, together with other members of the police and members of the Army of the Serb Republic of BiH, in the village of Gornja Bioča, Ilijaš municipality, he participated in the attack on civilians which resulted in the death and severe bodily injuries to civilians, some of whom were minors.  

The defendant is also charged with unlawful deprivation of liberty and imprisonment of Bosniak civilians, who were subsequently taken to other camps and detention facilities.

The defendant is charged with having acted contrary to provisions of the Geneva Conventions of 12 August 1949 relative to the Protection of Civilian Persons in Time of War and to the Protection of Victims of International Armed Conflicts. In addition, he is charged with the criminal offense of War Crimes against Civilians in violation of Article 173(1) a), c) and e), in conjunction with Article 180(1) and Article 29 of the Criminal Code of Bosnia and Herzegovina.

The Indictment has been submitted to the Court of BiH for confirmation.
