ON 21 JULY, THE PROSECUTOR’S OFFICE OF BOSNIA AND HERZEGOVINA RECEIVED INFORMATION FROM THE COURT OF BOSNIA AND HERZEGOVINA ON THE CONFIRMATION OF THE INDICTMENT IN THE ZIJAD MUTAP ET AL. CASE

  • ON 21 JULY, THE PROSECUTOR’S OFFICE OF BOSNIA AND HERZEGOVINA RECEIVED INFORMATION FROM THE COURT OF BOSNIA AND HERZEGOVINA ON THE CONFIRMATION OF THE INDICTMENT IN THE ZIJAD MUTAP ET AL. CASE

FIVE PERSONS INDICTED FOR ORGANIZED CRIME AND PREVENTING DETECTION AND TEMPERING WITH EVIDENCE OF DŽENAN MEMIĆ’S DEATH

The Prosecutor’s Office will prove the allegations of the prosecution by calling 88 witnesses, 16 of whom will have protection measures assigned to them, as well as by enclosing about 150 pieces of evidence.

A Prosecutor of the Prosecutor’s Office of Bosnia and Herzegovina has issued an Indictment against the following persons:

1.      Zijad Mutap, born in 1959 in Sarajevo

2.      Alisa Ramić (née Mutap), born in 1996 in Germany

3.      Hasan Dupovac, born in 1973 in Hadžići

4.      Josip Barić, born in 1963 in Sarajevo

5.      Muamer Ožegović, born in 1981 in Foča

The aforementioned accused persons are charged with joining a group for organized crime in the period from 8 February 2016 onwards, which was formed by Zijad Mutap and others and which was organized in order to conceal evidence of the manner in which Dženan Memić, son of Muriz, born in 1994, suffered severe life-threatening bodily injuries on 8 February 2016 in Velika Aleja, in Ilidža Municipality, as a result of which injuries he died on 15 February 2016, at the Clinical Center in Sarajevo.

The Indictment alleges that these accused persons covered up evidence and concealed perpetrators by faking evidence and concealing facts known to them, and that they took actions with the aim of hiding the actual manner in which Dženan Memić suffered severe and life-threatening bodily injuries.

According to the allegations in the Indictment, by prior agreement, the accused Zijad Mutap had contacts with several persons, including the accused persons, who, in agreement with him and by his instructions, in order to conceal the perpetrators and the manner of Dženan Memić’s death, personally committed illegal acts in the way that they took evidence in the form of video surveillance recordings even though they did not have authorization to do so nor an order of the competent court, and they illegally faked and planted evidence that actually were not real evidence, they led the officers of the Sarajevo Canton Ministry of the Interior to create and sign documents that do not correspond to the established factual situation, and they submitted fake expert reports and presented them as real evidence, whereby they obstructed and mislead the investigation, concealed the facts known to them and destroyed evidence gathered from the crime scene relating to the death of Dženan Memić, all that with the intention of covering up the real perpetrators and the actual manner in which Dženan Memić sustained severe bodily injuries to which he succumbed.

The aforementioned accused persons are charged with the following criminal offenses:

-          Organized Crime, in conjunction with the criminal offenses of Illegal Interceding, Accessory After the Fact, Tampering with Evidence and Giving False Statement.

The Prosecutor’s Office of Bosnia and Herzegovina continues to work intensively in this case in relation to other reported persons.
