LJUBIŠA (1976) AND MILAN MIHAJLOVIĆ (1946) CONCLUDED PLEA AGREEMENTS

Two persons accused of committing the criminal offense of Illicit trade in Excise Products under Article 210a of the Criminal Code of BiH, entered into plea agreements with the Prosecutor of Department III.

-        The accused Ljubiša Mihajlović - born on December 6, 1976 in Tuzla, residing in Doboj, BiH citizen - entered into plea agreement with the Prosecutor of the Prosecutor's Office of BiH. The Prosecutor proposed that the accused Ljubiša Mihajlović be rendered an imprisonment sentence in duration of one (1) year by the Court of BiH, which will not be executed providing that he does not commit another criminal offence within the period of two (2) years. The prosecutor also proposed that a fine of 5.000,00 BAM be imposed as an additional punishment for the accused.

-        The accused Milan Mihajlović, born on January 1, 1946 in Lukavac, residing in Doboj, BiH citizen - entered into plea agreement with the Prosecutor of the Prosecutor's Office of BiH. The Prosecutor proposed that the accused Milan Mihajlović be rendered an imprisonment sentence in duration of six (6) months by the Court of BiH, which will not be executed providing that he does not commit another criminal offence within the period of one (1) year.

By virtue of signing the agreements the accused persons fully admitted committing the criminal offense they were charged with by the indictment of the Prosecutor’s Office of BiH issued on April 17, 2013.

The proposed sentences are in line with the role of the accused persons in commission of the criminal offense.

With this agreement the accused persons confirm that they are aware of the content of the indictment issued by the BiH Prosecutor's Office on April 17, 2013. They also confirm that the plea statements were given voluntarily, knowingly and with full understanding and undertake to reimburse the costs of the criminal proceedings in the amount that may eventually be determined by the Court of BiH.

Pursuant to the agreements the accused have waived their rights to a trial and appeal to the criminal sanction that shall be rendered to them by the Court of BiH.

The agreements were submitted to the Court of BiH.
