AFTER ENTERING GUILTY PLEA AGREEMENT, THE ACCUSED OF THE CRIMINAL OFFENCE OF ILLEGAL TRADE IN MEDICINES SENTENCED TO SUSPENDED PRISON SENTENCES

The defendants Amel and Amer Velić (1991) entered a guilty plea agreement, after which they were sentenced in the Court of Bosnia and Herzegovina to suspended prison terms, Amel in the duration of one (1) year and Amer in the duration of six (6) months, which will not be served if the accused does not commit a new criminal offence within three (3) years from the date the judgment becomes final.

AFTER ENTERING GUILTY PLEA AGREEMENT, THE ACCUSED OF THE CRIMINAL OFFENCE OF ILLEGAL TRADE IN MEDICINES SENTENCED TO SUSPENDED PRISON SENTENCES

They were found guilty of the criminal offence of illicit trade set out in Article 212 (1), in conjunction with Article 29 of the Criminal Code of Bosnia and Herzegovina.

The allegations against the accused are that during 2021 they illegally procured medicines and medical devices the distribution of which requires appropriate approvals from relevant institutions, and placed them in circulation without authorisation through a user profile on an internet classifieds site.

In accordance with the agreement, the funds used to commit the criminal offence, including medicines and medical supplies, will be confiscated from the accused.

Pursuant to Articles 110 and 111 of the Criminal Code of Bosnia and Herzegovina, the unlawful property gain acquired through a criminal offence in the amount of EUR 12,735 and BAM 9,940 will be confiscated from the accused.

Punishing this type of criminal offence is important, as it causes great damage and danger to the health of the population because the mentioned medications did not go through the processes and standard controls of pharmaceutical products that are prescribed in Bosnia and Herzegovina.

The guilty plea agreement was forwarded to the Court of Bosnia and Herzegovina, which accepted it and sentenced the accused.
