INDICTMENT ISSUED AGAINST NEDELJKO ĐUKIĆ (1946) FOR WAR CRIMES AGAINST CIVILIANS

A Prosecutor of the Special Department for War Crimes within the Prosecutor’s Office of BiH issued an indictment against Nedeljko Đukić aka "Neđo" and "Đuka", born on August 18, 1946 in Maljava - a place located in Kotor Varoš municipality where he resides, citizen of Bosnia and Herzegovina.

INDICTMENT ISSUED AGAINST NEDELJKO ĐUKIĆ (1946) FOR WAR CRIMES AGAINST CIVILIANS

The accused is charged with having acted contrary to the Geneva Conventions and Additional Protocol II in time of war and armed conflict in Bosnia and Herzegovina, while acting in his capacity as a reserve officer with the Public Security Station (PSS) Kotor Varoš, and from September 1992 in capacity of a guard in a prison in Kotor Varoš, and with having aided and abetted, together with other members of the army and police with pending criminal proceedings before the Court of BiH, thus participating in murder, intentional infliction of severe physical and mental pain and suffering and inhumane treatment of the non-Serb civilians, and pillaging of property that belonged to non-Serb population.

The accused is charged with having participated in the beatings of prisoners who were kicked and hit with guns, clenched fists, sticks and various other items, during the period from June through to the end of 1992 in the prison located behind the building of the Basic Court in Kotor Varoš where the premises of the Territorial Defense of Kotor Varoš were also located and where non-Serb civilians were illegally incarcerated. As all of the prisoners were hit multiple times they sustained serious physical injuries. The accused is also charged with having been responsible for inflicting serious physical injuries, causing the death of one person.

The indictment alleges that Nedeljko Đukić has, under the threat of the use of firearms, on several occasions, together with other unknown persons forced the prisoners to rob movable items from abandoned houses of non-Serbs from the territory of Kotor Varoš.  Đukić and his accomplices appropriated the movables for themselves.

The accused is charged with the criminal offense of War Crimes against Civilians under Article 173 of the Criminal Code of BiH as read with Articles 29 and 180, Paragraph 1 of the CC BiH.

The indictment was forwarded to the Court of BiH for confirmation.
