A MOTION FOR CUSTODY FILED AGAINST TWO SUSPECTS

A Prosecutor of the Prosecutor’s Office of BiH put forward a Motion with the Court of BiH seeking custody against two suspects for whom there is a grounded suspicion that they committed the criminal offense of Crimes against Humanity, as referred to in Article 172, Paragraph 1, Item (h) of the Criminal Code of Bosnia and Herzegovina.

The Prosecutor of the Special Department for War Crimes within the Prosecutor’s Office of BiH in charge of the respective case put forward a Motion for Custody against the following suspects:

- Neđeljko Kuljić, born on 18 June 1950 in Simijova, Bileća Municipality, where he also resides and

- Željko Ilić, born on 10 October 1962 in Bileća, where he also resides.

The aforementioned persons were deprived of liberty in the morning of 15 January 2014 by the authorized SIPA officers. They are subject to investigation of the Prosecutor’s Office of BiH and are suspected of participating as police officers in unlawful arrests, torture, beating and mistreating of imprisoned Bosniak and Croat civilians in several facilities, including the Police Station. One prisoner died, and more than 150 persons were imprisoned.

Having been deprived of liberty, the aforementioned suspects were handed over to the Prosecutor in charge of the case who questioned them as suspects and then forwarded the Motion with the Court of BiH seeking custody for reasons stipulated in Article 132, Paragraph 1, Item (b) of the BiH CPC, or due to the risk that the suspects might hinder the criminal proceedings by influencing witnesses, accessories or accomplices.  

The Motion for Custody was forwarded to the Court of BiH, and the Prosecutor’s Office of BiH continues its investigation in this case.
