CUSTODY MOTION FOR THE SUSPECT OF MIGRANT SMUGGLING

The Prosecutor’s Office of Bosnia and Herzegovina filed a motion to the Court of Bosnia and Herzegovina for remand in custody of the suspect Matija Stanišić*, born in 2005 in Nikšić, a citizen of Montenegro. The remand in custody was sought for the reasons prescribed in Article 132, paragraph 1, point a) of the CPC of BiH, that is, due to risk of flight of the suspect who is a foreign citizen. It is alleged that after he entered the territory of Bosnia and Herzegovina on 11 June 2026 with his vehicle, near the state border of Bosnia and Herzegovina and Montenegro somewhere in the area of the municipality of Bileća he accepted into his vehicle a person who illegally entered Bosnia and Herzegovina from the territory of Montenegro, after which he was discovered by members of the RS MoI, Police Station Ljubinje and prevented from further smuggling of the said person. He is suspected of the criminal offense of Smuggling of Persons under Article 189, Paragraph 2 of the Criminal Code of BiH. The Court of Bosnia and Herzegovina accepted the motion and ordered remand in custody of the suspect for 30 days.

INDICTMENT ISSUED AGAINST 12 PERSONS, INCLUDING FOREIGN CITIZENS, FOR ORGANIZED SMUGGLING OF SEVERAL HUNDREDS OF MIGRANTS

The Prosecutor’s Office of BiH issued an indictment against 12 accused persons who are charged with having participated in at least 27 individual events, acting as an organized group, in the period from September to November 2025, in organizing and carrying out the smuggling of several hundred illegal migrants from the territory of Serbia (to a lesser extent from Montenegro) into BiH, most often across the Sava and Drina rivers, and their further smuggling within BiH with the aim of transporting them to EU countries. They are charged with the criminal offenses of Organizing a group or an association for the purpose of perpetration of the criminal offences of Trafficking in Persons and Smuggling of Migrants under Article 189a. and in conjunction with the criminal offense of Smuggling of Persons under Article 189 of the Criminal Code of BiH, and the accused Savić also for the criminal offense of Illicit trade in Excise Products under Article 210a of the Criminal Code of BiH. Significant cooperation was achieved in the case with partner institutions of the Republic of Serbia, supported by the EU4FAST project.
