INDICTMENT ISSUED FOR ILLICIT TRADE IN EXCISE PRODUCTS

The accused Bojana Milojević (1984) from Ljubinje is charged with illegally putting into circulation more than a hundred kilograms of tobacco which did not have appropriate excise stamps of Bosnia and Herzegovina.

INDICTMENT ISSUED FOR ILLICIT TRADE IN EXCISE PRODUCTS

A Prosecutor of the Prosecutor’s Office of Bosnia and Herzegovina has issued an Indictment against the following person:

-          Bojana Milojević, born in 1984 in Mostar, residing in Ljubinje, a citizen of Bosnia and Herzegovina.

This accused person is charged that, during 2020, in order to avoid the payment of excise duties defined in the provisions of the Law on Excise Duties of Bosnia and Herzegovina, and in order to acquire unlawful material gain, knowing that cut tobacco may not be traded between natural persons, she packed a large quantity of tobacco (about 105 kilograms) and sent it by express mail to a buyer in the area of Goražde.

The tobacco in the total value of around 16,700 BAM, which neither had proper documentation nor excise duties paid, was discovered and seized in the area of Mostar, during the control of an express mail cargo vehicle by authorized persons of the Indirect Taxation Authority (ITA BiH).

The aforementioned accused person is charged with illegally putting into circulation products that are not marked with control and tax stamps in the manner prescribed by the tax legislation of Bosnia and Herzegovina, thus acquiring unlawful material gain and causing damage to the budget of Bosnia and Herzegovina and its citizens, as she was placing on the market tobacco products that did not satisfy the prescribed standard of quality control and correctness.  

The Indictment of the Prosecutor’s Office of Bosnia and Herzegovina charges the accused with the commission of the criminal offense of Illicit Trade in Excise Products, referred to in Article 210a, paragraph 1 of the Criminal Code of Bosnia and Herzegovina.

The Indictment has been forwarded to the Court of Bosnia and Herzegovina for confirmation.
