CUSTODY AND PROHIBITING MEASURES PROPOSED AGAINST PERSONS SUSPECTED OF CRIMES OF ABUSE OF OFFICE AND EXTORTION

The measure of custody has been proposed against the suspect Darko Marčetić (1974), whereas prohibiting measures have been proposed against the suspect Adnan Aličić (1979).

CUSTODY AND PROHIBITING MEASURES PROPOSED AGAINST PERSONS SUSPECTED OF CRIMES OF ABUSE OF OFFICE AND EXTORTION

Having questioned the suspects, the Prosecutor in charge of the case has put forward a Motion with the Court of Bosnia and Herzegovina, seeking that the measure of custody be ordered against the suspect Darko Marčetić, SIPA Inspector from the Banja Luka Regional Office.

The measure of custody has been requested in accordance with the provisions of Article 132, paragraph 1, item b) of the Criminal Procedure Code of Bosnia and Herzegovina, due to the danger that, if at large, the suspect might hinder the inquiry and influence witnesses or accessories.

In regard to the suspect Adnan Aličić, the Motion requesting prohibiting measures has been forwarded in accordance with the provisions of Article 126 and Article 126a of the Criminal Procedure Code of Bosnia and Herzegovina, and such measures include travel ban, prohibition from meeting with certain persons and obligation to report to a specified police authority.  

The aforementioned suspects are subject to investigation by the Prosecutor’s Office of Bosnia and Herzegovina and they are suspected to have committed the criminal offence of Abuse of Office or Official Authority, as referred to in Article 220 of the Criminal Code of Bosnia and Herzegovina, and the criminal offence of Extortion, as referred to in Article 295 of the Criminal Code of the Federation of Bosnia and Herzegovina.

The above-mentioned Motions have been forwarded to the Court of Bosnia and Herzegovina.
