BIH PROSECUTOR´S OFFICE PUTS FORWARD A MOTION FOR CUSTODY AGAINST THE SUSPECT MILENKO KRSMANOVIĆ

Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor´s Office of Bosnia and Herzegovina has put forward a Motion with the Court of Bosnia and Herzegovina proposing custody against the suspect Milenko Krsmanović aka Krša, born on 24 January 1957 in Bijele Vode in the Municipality of Sokolac, a citizen of Bosnia and Herzegovina, who is suspected to have committed the criminal offense of Obstruction of Justice (as referred to in Article 241 of the Criminal Code of Bosnia and Herzegovina) and the criminal offenses of Murder and Incitement (as referred to in Article 148 and Article 24 of the Criminal Code of Republika Srpska, respectively).

The suspect for whom the Prosecutor in charge of the case has requested custody was deprived of liberty yesterday, in the area of Sokolac, by authorized members of the Police Department of the Sarajevo Canton Ministry of the Interior and the State Investigation and Protection Agency (SIPA).

The aforementioned suspect was deprived of liberty in the course of the action which uncovered and prevented the commission of a serious criminal offense, namely a planned killing of a well-known attorney-at-law from Sarajevo.

Having questioned the suspect, the Prosecutor in charge of the case has put forward a Motion with the Court of Bosnia and Herzegovina proposing the measure of custody for a term of one (1) month, for reasons as stipulated in Article 132, Paragraph 1, items b) and c) of the Criminal Procedure Code of Bosnia and Herzegovina.

Inter alia, the measure of custody has been proposed due to the risk that the suspect, if at large, might conceal evidence, or influence witnesses or accessories in order to prevent the collection of evidence or the conduct of the investigation, but also due to the justified fear that the suspect, if at large, might repeat the same criminal offense or commit a similar criminal offense.  

The Motion for Custody has been submitted to the Court of Bosnia and Herzegovina.
