THREE EMPLOYEES OF ITA BIH ACCUSED OF ABUSE OF OFFICE OR OFFICIAL AUTHORITY AND OF LACK OF COMMITMENT IN OFFICE. DAMAGES CAUSED AMOUNT TO NEARLY BAM 800 000

A Prosecutor of the Prosecutor’s Office of BiH issued an indictment against the following persons:

THREE EMPLOYEES OF ITA BIH ACCUSED OF ABUSE OF OFFICE OR OFFICIAL AUTHORITY AND OF LACK OF COMMITMENT IN OFFICE. DAMAGES CAUSED AMOUNT TO NEARLY BAM 800 000

1. Haračić Ćamil, born on December 12, 1958 in Tuzla, employee of ITA - Regional Center Tuzla,

2. Bubalović Kata born on May 20, 1958 in Gradačac, employee of ITA - RC Tuzla,

3. Žugić Dragica, born on May 30, 1962 in Zvornik, employee ITA - RC Tuzla.

The accused are charged with having taken advantage of their authorities, while acting in their capacities as employees and officers of the ITA - Regional Centre Tuzla working in the Group for Audit and Control of the Tax Division, and with having consciously violated the law and regulations while controlling the health institution: special hospital “BiH Heart Center” in Tuzla by way of illegally calculating indirect taxes thus allowing for illegal VAT return amounting to about BAM 794 000 to which the BiH Heart Center was not entitled to as it was not listed in the VAT payers system in the calculating period.

In this manner, the institution in question was provided with an illegal property gain in the above-listed amount, which is the amount of damages caused to the budget and all citizens of Bosnia and Herzegovina.

The accused Haračić Ćamil is charged with the criminal offense of Abuse of Office or Official Authority under Article 220, Paragraph 1 of the CC BiH; the other two accused persons Bubalović Kata and Žugić Dragica are charged with the criminal offense of Lack of Commitment in Office under Article 224, Paragraph 2 of the CC BiH.

In addition to the indictment, the Prosecutor’s Office submitted a list of 13 witnesses and experts it intends to examine and more than 50 exhibits that will prove the guilt of the accused persons.

The indictment was forwarded to the Court of BiH for confirmation.
