CUSTODY PROPOSED AGAINST TWO SUSPECTS

Prosecutor of the Prosecutor’s Office of BiH has put forward a motion with the Court of BiH seeking custody against two persons suspected of the criminal offense of Organized Crime, as referred to in Article 250, Paragraph 1, in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs, as referred to in Article 195, Paragraph 1, of the Criminal Code of BiH.

Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of BiH has put forward a motion with the Court of BiH seeking custody against the following suspects:

1.     Goran Jovanović, citizen of BiH and

2.     Leon Mendez (in Croatia, Anto Čančarević), citizen of BiH and the Republic of  Croatia.

The aforementioned suspects were deprived of liberty in the morning of 30 May 2013, by the authorized police officers of the State Investigation and Protection Agency- SIPA and were subsequently handed over to the Prosecutor’s Office of BiH within the statutory time.  

The Prosecutor’s Office of BiH charges these suspects, as members of the international organized criminal group consisted of persons from the Republic of Croatia, Republic of Serbia, Kingdom of the Netherlands and Republic of Germany,   with arranging the procurement of narcotics from the territory of South America, across the territories of the Kingdom of the Netherlands and Belgium, for the purpose of further sale of this drug in the territory of the Republic of Germany and in other countries of Central and Eastern Europe.  

Having questioned the suspects, the Prosecutor in charge of this case has put forward a motion with the Court of BiH seeking custody for reasons stipulated in Article 132, Paragraph 1, items a), b), and c) of the BiH CPC.

The measure of custody was proposed against these suspects due to the risk of flight. The measure of custody was also proposed due to the risk that the suspects, if at large, might hinder the investigation, conceal evidence or influence witnesses or accessories, as well as due to the risk that the suspects might repeat the already commenced criminal offence.

The motion for custody has been forwarded to the Court of BiH.
