CUSTODY MOTION, MOTION FOR IMPOSURE OF PROHIBITING MEASURES AS WELL AS A MOTION FOR ISSUANCE OF AN INTERNATIONAL ARREST WARRANT FILED

Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor's Office of BiH filed a motion with the Court of BiH for remand in custody, for imposure of prohibiting measures and for issuance of an international arrest warrant for 5 persons due to grounded suspicion that they committed the criminal offense of Organized Crime under Article 250, Paragraphs 3 and 2 in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195 Paragraph 1 of the CC BiH.

The suspects, for which the Assigned Prosecutor requested custody, were arrested by members of the State Investigation and Protection Agency - SIPA in coordination with members of the BiH Border Police and the Tuzla Canton MoI, at the border crossing Orašje; a large quantity of the narcotic drug Cocaine and the liquid mixture used for production of narcotic drugs were seized and a number of locations raided in the area of Banović.

Confiscated drugs and chemicals for the production of narcotic drugs will be subjected to forensic expert analysis to determine the type and concentration of the narcotic drugs in the seized matter.

According to preliminary tests, at least 1 kg of the narcotic drug cocaine, with a street value of tens of thousands of KM, was seized.

Subsequent examination of the seized matter may possibly determine that the quantity of cocaine is much higher.

The aforementioned seizure is one of the largest seizures of narcotic drug cocaine in recent years.

Following the questioning of the suspects, the Assigned Prosecutor filed a motion to the Court of BiH to remand the following persons into custody for a period of 30 days: M.M. (1979), M.D. (1977) and O.R. (1977), a motion for imposure of prohibiting measured was filed for suspects R.E. (1989) and M.E. (1986). Given that the suspect M.D. (1977) is on the run, it was requested that the Court of BiH, following its decision on remand in custody, issue an order calling for an international arrest warrant in acordance with Article 443 of the Criminal Procedure Code of Bosnia and Herzegovina.

The prosecutor requested custody on grounds stipulated in Article 132, Paragraph 1, Subparagraphs a), b) and c) of the CPC BiH.

Among other things, remand in custody was requested due to risk that the suspects could suppress evidence, influence witnesses or accomplices in order to prevent collection of evidence and to hinder the investigation. In relation to the requested remand in custody for M.M. and M.D. also for the risk of flight, and in relation to O.R. due to grounded suspicion that the suspect, if released, would repeat the criminal offense or commit a similar one.

In relation to suspects M.E. and R. E. the Assigned Prosecutor requested that prohibiting measures be imposed under Article 126a Subparagraphs c) and d) of the CPC BiH i.e. ban on meeting with other suspects and the obligation to report once a week to the police station in his/her place of residence.

The Prosecutor's Office of BiH and Law Enforcement Agencies continue with activities and investigation in this case aiming to proceed with indictments.
