INDICTMENT ISSUED AGAINST JASMIN SMAILAGIĆ (1959)

Prosecutor of Department III issued an indictment against Jasmin Smailagić AKA "Šeki" - born on July 20, 1959 in Bihać where he resides, a citizen of Bosnia and Herzegovina - charging him with the criminal offense of Impermissible Use of Copyrights under Article 243, Paragraph 1 of the Criminal Code of BiH.

The indictment charges Jasmin Smailagić to have, during the second half of the 2012 in his video store "Šeki" located in Bihać, placed copyrights (feature films, adult movies and cartoons of foreign and domestic production) a total of 6787 CDs/DVDs on the market, without the author's permission and aware that those were illegally made copies which is contrary to applicable legislation on copyrights.

The accused Jasmin Smailagić is charged to have put into circulation copyrights multiplied without permission of the author, other copyright holder or a person authorized to give permission, and as it is required under the Law of BiH he thereby committed the criminal offense of Impermissible Use of Copyrights under Article 243, Paragraph 1 of the CC BiH, in conjunction with the Law on Copyright and Related Rights ("Official Gazette of BiH", No. 63/10).

The indictment was forwarded to the Court of BiH for confirmation.
