Cooperation with The International Criminal Tribunal For The Former Yugoslavia

Considering the fact the ICTY Completion Strategy prevents it from completing the mandate assigned to it by Resolution 808 of the UN Security Council to prosecute “persons responsible for serious violations of international humanitarian law committed in the territory of the former Yugoslavia since 1991” and in respect of the events in BiH (the scene of the most serious, widespread and systematic crimes), the mandate has been given to relevant institutions in BiH as far as intermediate and lower-ranked suspects are concerned.

Having in mind that the ICTY and the Prosecutor's Office of Bosnia and Herzegovina will not be able to operate without the assistance of the ICTY Office of the Prosecutor, the Memorandum of Understanding Between the Office of the Prosecutor of the International Criminal Tribunal for the Former Yugoslavia and the Special Department of the Prosecutor's Office of the Prosecutor's Office of Bosnia and Herzegovina was signed in September 2005 which stipulates mutual cooperation between the signatories in relation to Requests for Assistance, access to documents, access to witness statements, contacts with witnesses and witnesses with protective measures, access to expert reports etc.
