CUSTODY MOTION FILED FOR 5 PERSONS

The Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the BiH Prosecutor's Office filed a motion to the Court of BiH to order custody for five suspects with the following initials ČH (1984) PN (1974) OE (1983) KN (1973) and  ŠH (1970).

The suspects are under investigation for participating in the terrorist attack on the Police Department Bugojno (Bugojno PD) that occurred on June 27, 2010 at 04.50 hrs. when an unknown explosive device blew up killing a police officer of Bugojno PD, causing serious bodily injuries to several other authorized officials of Bugojno PD, as well as major material damage to the Bugojno PD building, the surrounding residential buildings and vehicles

The assigned prosecutor filed a motion to the Court of BiH to order custody, for reasons stipulated in Article 132, Paragraph 1, Subparagraphs a), b) and d) of the CPC of BiH i.e. due to risk that the suspects would flee, the fact that they are suspected of committing a serious criminal offense against humanity and values protected by international law, which carries a penalty of imprisonment of at least 10 years, as well as reasonable doubt that the suspects, if  released,  could destroy clues that are relevant to criminal proceedings , influence the witnesses, accomplices and aids.

The above mentioned offense has disturbed the public of Bosnia and Herzegovina, which certainly justifies the imposition of custody because the release of the suspects would resulted in a real threat of public order disturbance.

On the basis of all of the above, the BiH Prosecutor’s Office has filed a motion to the Court of BiH to order custody for all suspects, for a period of 30 days.
