ZULFIKAR ALIŠPAGO (1958) APPREHENDED

By order of the Prosecutor of the Department for War Crimes within the BiH Prosecutor's office Zulfikar Ališpago (1958), suspected of having committed the criminal offences of War Crimes against Civilians under Article 173 of the BiH Criminal Code and War Crimes against Prisoners of War under Article 175 of the BiH Criminal Code, was deprived of liberty today.

Members of the State Investigation and Protection Agency - SIPA have, pursuant to the order of the Prosecutor of the Special Department for War Crimes within the BiH Prosecutor's Office, arrested Zulfikar Ališpago AKA "Zuka", born on December  26, 1958 in Novi Pazar - Republic of Serbia, residing in Sarajevo, a citizen of BiH and the Republic of Serbia.

Zulfikar Ališpago is under investigation by the BiH Prosecutor's Office and is suspected to have, as Commander of the Special Unit for Particular Purposes, named "Zulfikar",  functioning within the Supreme Command Staff of the Army of RBiH,  acted contrary to the provisions of Article 87 of the Additional Protocol I to the Geneva Convention of August 12, 1949 and by doing so committed the criminal offence of War Crimes against Civilians under Article 173 of the BiH Criminal Code and War Crimes against Prisoners of War under Article 175 of the BiH Criminal Code.

The suspect -Zulfikar Ališpago, as a superior and a person with an actual and effective control over members of the Special Unit for Particular Purposes "Zulfikar" of the Supreme Command Staff of the Army of the Republic of Bosnia and Herzegovina, failed to take necessary and reasonable measures to punish the perpetrators although he knew that his subordinates i.e. members of the "Zulfikar" unit committed crime, by which he committed the criminal offence of War Crimes against Civilians under Article 173, paragraph 1, subparagraphs a) and c) of BiH CC and the criminal offence of War Crimes against Prisoners of War under Article 175, paragraph 1, subparagraph  a) of the BiH Criminal Code, in conjunction with Article 180, paragraph 2 of the same Code.

The BiH Prosecutor's Office has collected sufficient evidence to support the claim that the suspect is responsible for the crimes committed and arrested him.

The War Crimes in Trusina village – Konjic municipality, were committed on April 16, 1993 when 22 persons of Croat ethnicity i.e. 19 civilians and 3 soldiers of the HVO (Croatian Defense Council) who had previously surrendered were killed and 4 persons wounded, including two children.

The suspect shall be handed over to the Assigned Prosecutor of the BiH Prosecutor's Office within the legal deadline, and the Prosecutor will question him and later decide whether to file a motion to order custody.
