INDICTMENT ISSUED AGAINST TWO PERSONS FOR SMUGGLING OF GOODS AND ACCESSORY AFTER THE FACT

04.12.2012. 15:09
The Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor's Office of BiH issued an indictment against: J.B. - born in 1978 in Mostar, residing in Ljubuški, a citizen of Bosnia and against B.O. - born in 1973 in Ljubuški, where he resides, a citizen of Bosnia and Herzegovina.

The indictment charges J.B. to have on June 9, 2007 at the border crossing of Gorica, while performing regular import and by using his status of a driver in a legal entity - company, moved goods in the value of 96.171.50 Euro i.e. 188,015.28 BAM across the customs line.

The accused is charged to have hidden a total 683 mobile devices, 10 navigation devices and 5 memory cards into the driver’s cabin of a "MAN" truck in the intent to evade customs control while transporting the aforementioned goods across the customs line. He is therefore charged with the criminal offense of Smuggling of Goods under Article 214 Paragraph 1 of the Criminal Code of BiH.

The accused B.O. is charged with having aided the primary accused J.B. after he had smuggled the goods i.e. transferred the goods across the customs line from Croatia to BiH. He is charged with having rendered assistance to the perpetrator of a criminal offence to avert his detection, to have concealed goods acquired through the criminal offense of Smuggling of Goods and is hence charged with the criminal offense of Accessory After the Fact under Article 232, Paragraph 2 in conjunction with Paragraph 1 of the Criminal Code of BiH.

The indictment was forwarded to the Court of BiH for confirmation.
