CUSTODY MOTION FILED FOR EIGHTEEN PERSONS

14.09.2012. 15:10
Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor's Office of BiH shall file a motion to the Court of BiH to remand eighteen suspects, who are under investigation for a number of serious crimes committed in Bosnia and Herzegovina in the last few years, into custody.

The suspects for whom the Prosecutor will seek detention, were deprived of liberty on September 12, 2012 in a joint police operation codenamed "Lutka" /doll/, which involved hundreds of police and law enforcement officers from both the state and entity levels. This case involved significant cooperation with police and judicial agencies of neighboring countries, where a number of suspects are located.

Following the questioning of the suspects, the Prosecutor shall file a motion to the Court of BiH to remand eighteen suspects into custody for a period of 30 days.

Detention is requested on grounds stipulated in Article 132, Paragraph 1, Subparagraphs a), b), c) and d) of the CPC BiH i.e. the risk of flight, the risk that the suspects could suppress evidence and influence witnesses or accomplices in order to prevent the collection of evidence and hinder the investigation, due to grounded suspicion that the suspects, if released, could repeat the criminal offence or commit a similar one, due to the manner of the commission of the offense and the consequences thereof and due to the disturbance to the entire population of Bosnia and Herzegovina.

All suspects are under investigation by the Prosecutor's Office of BiH and are suspected with the following criminal offenses: Organized Crime under Article 250 of the CC BiH, Conspiracy to Perpetrate a Criminal Offence under Article 247 of the CC BiH, Preparation of a Criminal Offence under Article 248 CC BiH, Illicit Trafficking in Narcotic Drugs under Article 195 of CC BiH, Organized Crime under Article 383 of the CC RS, Conspiracy to Commit a Criminal Offence under Article 384 of the CC RS, First Degree Murder under Article 149 of the CC RS, Organized Criminal Group under Article 342 of the CC FBiH, Money Laundering under Article 209 of the CC BiH, Aggravated Robbery under Article 289 of the CC FBiH and Murder under Article 166 of the CC FBiH.

The Prosecutor's Office of BIH will file a motion to the Court of BiH to issue an international arrest warrant and order custody for several persons who were not located during yesterday's operation of SIPA.

Custody motion shall be submitted to the Court of BiH.
