CUSTODY MOTION FILED FOR 14 PERSONS

The BiH Prosecutor's Office filed a motion to the Court of BiH to order custody for fourteen persons, suspected of committing the criminal offense of Organized Crime under Article 250, Paragraphs 2 and 3 in conjunction with criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 1 of the Criminal Code of BiH.

The Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the BiH Prosecutor's Office filed a motion to the Court of BiH to order custody for the following persons:

1.   Perić Dario AKA “Crni”, born on April 23, 1975 in Stolac where he also resides, BiH citizen, 

2.   Perić Tomislav AKA “Tomo“, born on March 8, 1973 in Mostar, residing in Stolac municipality, citizen of BiH and Republic of Croatia,

3.   Milić Aleksandar AKA “Sale”, born on February 23, 1972 in Trebinje where he resides,  BiH citizen, 

4.   Milićević Slobodan AKA “Boban“ or „Brko”, born on February 28, 1957 in Brčko, residing in Bileća municipality, BiH citizen, 

5.   Toholj Desko AKA “Brko”, born on May 10, 1951 in Ljubinje where he resides, BiH citizen, 

6.   Đulić Musair AKA “Musa”, born on August 15, 1970 in Stolac municipality where he resides, BiH citizen, 

7.   Rizvanbegović Hamdija AKA “Hamdo”, born on May 3, 1972 in Stolac where he resides, BiH citizen, 

8.   Kosjerina Gordan AKA “Goća”, born on February 13, 1966 in Sarajevo, residing in Ljubinje municipality, BiH citizen, 

9.   Ivanković Amir, born on January 6, 1985 in Stolac where he resides,  BiH citizen, 

10.    Prce Josip AKA “Jopa”, born on August 20, 1987 in Mostar, residing in Čapljina municipality, citizen of BiH and Republic of Croatia,

11.    Raguž Luka, born on July 15, 1969 in Čapljina where he resides, BiH citizen,

12.    Šljivić Šimo, born on October 2, 1979 in Kakanj, residing in Stolac municipality, citizen of BiH and Republic of Croatia,

13.    Rahić Ermin, born on April 13, 1989 in Čapljina where he resides, BiH citizen,  and

14.    Katica Alen, born on February 28, 1972 in Mostar where he resides, BiH citizen.

All of the above-mentioned persons were deprived of liberty on July 7, 2010 early in the morning by officials of the State Investigation and Protection Agency - SIPA and handed over to the BiH Prosecutor's Office the very same day, where they were examined as suspects by the assigned prosecutor.

All of these persons are suspected to have committed the criminal offense of Organized Crime under Article 250, Paragraphs 2 and 3 in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 1 of the Criminal Code of BiH.

Custody motion for the suspects was filed for reasons stipulated in Article 132, Paragraph 1, Subparagraphs a), b), c) and d) of the CPC of BiH. Among other things custody motion was filed due to risk  of flight, as well as the fact that a few of them possess the citizenship of Republic of Croatia, due to the fact the criminal offense in question envisages an imprisonment sentence of more than 10 years, considering the type of crime as well as the manner of perpetration, there is a risk that  if released the suspects could again commit the criminal offense, influence the witnesses or accomplices and obstruct the course of the investigation.
