The indictment alleges that Hadrović Naim has on January 23, 2010 purchased at the "Arizona" market a total of 4559 CDs and DVDs, containing music from various artists and movies and cartoons from various authors, which he intended to put into circulation at his stall at the market "Heco-prom "in Sarajevo. The indictment further alleges that Đogić Esmir transported the above mentioned CDs and DVDs, together with Hadrović Naim, in his vehicle in the direction of Sarajevo, despite knowing that those were illegal, so-called "pirated" copies.

Both accused were aware that these were illegal copies made contrary to Article 34 of Copyright and Related Rights Law in Bosnia and Herzegovina (Official Gazette of BiH no. 7/02) i.e. without the consent of the author or other holder of copyright or the person entitled to grant such an approval pursuant to BIH Law.

During a routine traffic control on the main road Doboj-Tuzla they were inspected by officials of Doboj PS, who have seized the above mentioned illegal copies of CDs and DVDs from the accused.

The accused are charged with having committed the criminal offense of Impermissible Use of Copyrights under Article 243, Paragraph 4 of the Criminal Code of BiH, all in conjunction with the Copyright and Related Rights Law in BiH (Official Gazette of BiH  No. 7 / 02).

The indictment was forwarded to the Court of BiH for confirmation.
