INDICTMENT ISSUED FOR THE CRIMINAL OFFENCE OF ILLICIT TRADE IN EXCISE PRODUCTS

Prosecutor of the Department II of the Prosecutor’s Office of Bosnia and Herzegovina has issued an Indictment against the following person:
  • INDICTMENT ISSUED FOR THE CRIMINAL OFFENCE OF ILLICIT TRADE IN EXCISE PRODUCTS

- KASIM GOLUBOVIĆ, born in 1966 in Golubovići, in Velika Kladuša Municipality, a citizen of Bosnia and Herzegovina.

According to the allegations in the Indictment, Golubović is charged with transporting a larger quantity of dry cut tobacco, on 19 June 2017, which was not labelled with excise stamps as prescribed by the tax legislation of Bosnia and Herzegovina, and which he intended to put into circulation, in order to acquire unlawful material gain.

In the evening of the above-mentioned day, on the M14 highway from Novi Grad to Bosanska Krupa and in the place called Bosanska Otoka, in the border area of Bosnia and Herzegovina and the Republic of Croatia, the accused was transporting 120.036 kilograms of dry cut tobacco, packed in plastic bags, in the trunk of his passenger’s motor vehicle, which tobacco he had previously procured in the Banjaluka market area, from a person known to him.

During the inspection of the said motor vehicle, authorized officers of the Border Police of Bosnia and Herzegovina seized the aforementioned tobacco, which was intended for the sale in the black market.

The tax and excise duties for one kilogram of dry cut tobacco amount to BAM 100, approximately; accordingly, the smuggling of around 120 kilograms of dry cut tobacco has damaged the budget of Bosnia and Herzegovina for an approximate amount of BAM 10,000.  

The aforementioned accused person is charged with the commission of the criminal offense of Illicit Trade in Excise Products, as referred to in Article 210a, in conjunction with Article 26 of the Criminal Code of Bosnia and Herzegovina.

The Indictment has been forwarded to the Court of Bosnia and Herzegovina for confirmation.
