THE ACCUSED IN THE CASE CODENAMED ‘DŽOKER’ /JOKER/ ENTERS INTO A PLEA AGREEMENT ADMITTING GUILT UNLAWFUL PROPERTY GAIN TO BE CONFISCATED

By virtue of this Plea Agreement, the property gain in the amount of EUR 7,465.00, which was acquired through the commission of the criminal offense, will be confiscated, whereas 1,980 packs of cigarettes of various brands and mobile telephones will be temporarily seized. 
  • THE ACCUSED IN THE CASE CODENAMED ‘DŽOKER’ /JOKER/ ENTERS INTO A PLEA AGREEMENT ADMITTING GUILT UNLAWFUL PROPERTY GAIN TO BE CONFISCATED

The accused Radovan Kezija (1970), who has been accused in a case pertaining to smuggling of cigarettes, has admitted his guilt and signed a Plea Agreement in the presence of his defence attorney, in relation to the criminal offences committed in early 2014.

The aforementioned accused has fully admitted to have participated in the takeover, transport, transfer and handover of cigarettes to persons in the Republic of Croatia, for which activities they received certain amounts of money from the organizers, and eventually, the buyers of such cigarettes on which duties were not paid from the territory of the Republic of Croatia were avoiding the measures of customs control in the border area with Bosnia and Herzegovina and taking over the smuggled cigarettes from Bosnia and Herzegovina and selling them further on the territory of the Republic of Croatia at a significantly higher price.

In accordance with this Plea Agreement, both the Prosecutor and the aforementioned accused person agree that the Court of Bosnia and Herzegovina imposes upon the accused a suspended sentence of imprisonment for a term of two (2) years, determining at the same time that such a sentence will not be executed provided that the accused does not commit another criminal offense within the next three (3) years, counting from the day the Verdict becomes final and binding.

The proposed sentence corresponds to the role that this accused person had in the commission of the said criminal offence.

Having signed this Plea Agreement, the accused committed himself to testifying on all the facts known to him in this criminal case, as well as on all the perpetrators, co-perpetrators and accessories known to him, who participated in the commission of this criminal offense.

The accused confirms that he is informed of the content of the Plea Agreement and he also confirms that he enters this plea of guilty voluntarily, consciously and with understanding, and he takes upon himself an obligation to bear the costs arising from the criminal proceedings, in the amount that may be determined by the Court of Bosnia and Herzegovina.

As particularly mitigating circumstances in determining the aforementioned sentence, the Prosecutor has taken into account the fact that this accused person admitted his guilt, as well as that there were no harmful consequences, since the criminal offenses charged against this accused were prevented by police officers.

By virtue of signing this Plea Agreement, the accused waives his right to a trial and right to appeal to the Verdict rendered against him by the Court of Bosnia and Herzegovina.

This Plea Agreement has been forwarded to the Court of Bosnia and Herzegovina.
