THE ACCUSED ELVANA ČELJA (1987) ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

The accused Elvana Čelja, born on 07 April 1987 in Peć, resident of Sarajevo, citizen of BiH, accused of the criminal offense of Counterfeiting of Money, as referred to in Article 205, Paragraph 2 as read with Paragraph 1 of the Criminal Code of Bosnia and Herzegovina, has entered into a Plea Agreement with a Prosecutor of the Department III of the Prosecutor’s Office of BiH.  
  • THE ACCUSED ELVANA ČELJA (1987) ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

By virtue of signing this Plea Agreement, the accused person has fully admitted the commission of the criminal offense she is charged with by the Indictment of the Prosecutor’s Office of BiH dated 10 June 2009 and which was confirmed by the Court of BiH on 18 June 2009.  

In accordance with this Plea Agreement, both the Prosecutor and the accused person agree that the Court of BiH impose a suspended sentence of imprisonment in the duration of one (1) year on the accused Elvana Čelja and, at the same time, determine that this sentence will not be carried out if this accused person does not perpetrate another criminal offense over a period of two (2) years.

Pursuant to Article 205, Paragraph 5, of the Criminal Code of Bosnia and Herzegovina, two (2) counterfeit banknotes, each in the denomination of BAM 100.00, and one (1) banknote in the denomination of BAM 50.00 will be forfeited.

In determining this punishment, the following facts have been taken into consideration: the accused has plead guilty to the criminal offense charged with by the Indictment; she is young and mother of one underage child; she is unemployed; she is an indigent person; by signing this Plea Agreement, she has helped this case to be resolved in an expedited and economic manner and thus influenced the reduction of the costs of the criminal proceedings; also, there have been no aggravating circumstances on the side of the accused.

The proposed sentence is consistent with the role of the accused in the commission of the criminal offense.

With this Plea Agreement, this accused person confirms to be familiar with the content of the Indictment of the Prosecutor’s Office of BiH. At the same time, she confirms to have entered her plea of guilty voluntarily, consciously and with understanding.

By signing this Plea Agreement, this accused person waives her right to a trial and right to appeal to a criminal sanction imposed upon her by the Court of BiH, and that she is aware that she may cover the expenses of the criminal proceedings.

The Plea Agreement has been forwarded to the Court of BiH.
