BORIŠA BOLJANOVIĆ (1984) ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

The accused Boriša Boljanović entered into a Plea Agreement admitting guilt for the criminal offense of Organizing a Group or Association for Smuggling or Distribution of Goods on Which Duties Were Not Paid, as referred to in Article 215, Paragraph 2, in conjunction with Paragraph 1 of the Criminal Code of BiH.

The Plea Agreement admitting guilt was concluded with a Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of BiH by the following accused person:

-      Boriša Boljanović, born on 09 March 1984 in Bileća, where he also resides, citizen of BiH.

By virtue of signing the Plea Agreement, the accused fully admits committing the criminal offense he is charged with by the Indictment of the Prosecutor’s Office of BiH issued on 18 March 2013, which was confirmed by a Preliminary Hearing Judge of the Court of BiH on 29 March 2013.

The accused Boriša Boljanović is charged with being a member of an organized group for smuggling and distribution of the goods on which duties were not paid – cigarettes, from the period between March and early September of 2011, and this group smuggled a large quantity of cigarettes in the above-mentioned period.

Pursuant to the Plea Agreement, the Prosecutor agrees that a criminal sanction of a suspended sentence be imposed on the accused Boriša Boljanović by the Court of BiH for the criminal offense he committed, by pronouncing a prison sentence in the duration of two (2) years and at the same time determining that the sentence will not be carried out if this accused person does not perpetrate another criminal offense over a period of four (4) years.

Pursuant to Articles 110 and 111 of the Criminal Code of BiH, the amount of BAM 10,000.00 will be confiscated from the accused Boriša Boljanović as property gain acquired by the commission of the criminal offense. The accused is obliged to pay half of this amount, that is, BAM 5,000.00, immediately, whereas the remaining BAM 5,000.00 has to be paid by him after the Verdict of the Court of BiH, rendered pursuant to this Plea Agreement, becomes final. 

The proposed sentence is consistent with the role of the accused in the commission of the criminal offense described in the Indictment.

With this Plea Agreement, the accused confirms to be aware of the content of the Indictment issued by the BiH Prosecutor's Office. At the same time, he confirms to give his plea statement voluntarily, consciously and with understanding.

By signing this Plea Agreement, the accused person waives his right to a trial and the right to appeal to a criminal sanction imposed upon him by the Court of BiH on the basis of this Plea Agreement.  

The Plea Agreement was forwarded to the Court of BiH.
