THE ACCUSED FANG YERU (1978) CONCLUDED A PLEA AGREEMENT

The accused Fang Yeru concluded and Agreement on Admission of Guilt for the criminal offense of Tax Evasion under Article 210, Paragraph 2 in conjunction  with Paragraph 1 of the Criminal Code of Bosnia and Herzegovina.
  • THE ACCUSED FANG YERU (1978) CONCLUDED A PLEA AGREEMENT

The accused Fang Yeru - born on September 23, 1978 in Liaoning in PR China, residing in Zenica, citizen of PR China - entered into plea agreement with the Prosecutor of Department III within the Prosecutor’s Office of BiH.

By virtue of signing the agreement the accused person fully admitted committing the criminal offense she was charged with by the indictment of the Prosecutor’s Office of BiH issued on November 13, 2013.

Pursuant to the agreement the Prosecutor and the Defense agree that the accused be rendered a conditional imprisonment sentence in duration of one (1) year by the Court of BiH that will not be executed providing that the accused does not commit another criminal offense during the period of three (3) years following the final verdict.

The aforementioned sanction – conditional imprisonment, was proposed due to the fact that there are mitigating circumstances for the accused: she admitted guilt and settled all her tax obligations in full, more than seven years have passed since the actual criminal offense was committed and the accused Fang Yeru is a younger person and a sole provider for 4 underage children.

The aforementioned sanction – conditional imprisonment, was proposed due to the fact that the accused admitted guilt thus contributing to a more efficient and cost effective criminal proceeding, which along with the fact that there are no aggravating circumstances for the accused may serve to justify the proposed conditional sentence.

With this agreement the accused confirms that she is aware of the content of the indictment issued by the BiH Prosecutor's Office. She also confirms that the plea statement was given voluntarily, knowingly, with full understanding, without any coercion or inducement, and undertakes to reimburse the costs of the criminal proceedings in the amount of BAM 800 which relate to financial expert findings.

Pursuant to this agreement the accused has waived her right to a trial as well as her right to appeal the criminal sanction that shall be rendered to her by the Court of BiH.

The agreement was submitted to the Court of BiH.
