INDICTMENT ISSUED AGAINST JOSIP JONJIĆ I HUSEN MUQAJ

Prosecutor of Department III within the Prosecutor's Office of BiH issued an indictment against the following persons:
  1. Josip JONJIĆ born on April 28, 1968 in Zenica, where he permanently resides, a citizen of Bosnia and Herzegovina and
  2. Husen MUQAJ, born on October 14,   1976 in Prizren - Kosovo, permanently residing in Sarajevo.

The accused Josip JONJIĆ is charged to have, in accordance with the previous agreement with a third party from Kosovo and on an undetermined date prior to March 4, 2012, while working in the capacity of an authorized officer of the Border Police of BiH allowed citizens of the Republic of Serbia from the area of Kosovo, who did not possess a valid visa for entry to Bosnia and Herzegovina to cross the state border between the Republic of Montenegro and Bosnia and Herzegovina

As alleged in the indictment, the accused Husen MUQAJ has, during the day shift in which the accused Joseph Jonjić was on duty at border crossing Hum - Foča municipality, arrived with his motor vehicle "Mercedes" with BiH license plates and transported four persons from the area Kosovo across the border. Their entry to Bosnia and Herzegovina was ensured by the accused Josip JONJIĆ who had, at the time, supervised and controlled the border crossing, and had thus acted contrary to the applicable legal provisions.

Consequently, the accused Josip JONJIĆ is charged to have, as an authorized officer in the institutions of Bosnia and Herzegovina, received the promise of a gift, to act within his powers and allow actions that should not be permitted; the accused Husen MUQAJ is charged to have,  with the intent of obtaining illicit benefit, made possible a transfer one or several migrants across the border. By doing so the aforementioned accused persons have committed the following criminal offences: Josip JONJIĆ - the criminal offense of Accepting Gifts and Other Forms of Benefits of Article 217 Paragraph 1 of the Criminal Code of BiH, and Husen MUQAJ - the criminal offence of Smuggling of Persons under Article 189, Paragraph 1 of the same Code.

The indictment was forwarded to the Court of BiH for confirmation
