THE ACCUSED ELVEDINA HINDIĆ (1961) CONCLUDED A PLEA AGREEMENT

The accused Elvedina HINDIĆ concluded an Agreement on admission of guilt for the committed criminal offense of Illicit Trade in Excise Products under Article 210a of the Criminal Code of BiH.

The accused Elvedina HINDIĆ - born on November 1, 1961 in Jablanica where she resides, BiH citizen - entered into a plea agreement with the Prosecutor of Department III within the Prosecutor’s Office of BiH.

By virtue of signing the agreement the accused fully admitted committing the criminal offense she was charged with by the indictment of the Prosecutor’s Office of BiH issued on February 4, 2013 and confirmed on February 11, 2013.

Pursuant to the Agreement the Prosecutor and the Defense agree that the accused Elvedina HINDIĆ be rendered a conditional imprisonment sentence in duration of 9 (nine) months by the Court of BiH that shall not be executed providing that she does not commit another criminal offence within a 2 (two) year period.

Pursuant to the Agreement, and in accordance with Article 210a Paragraph 2 of the CC BiH, excise products listed in the disposition of the Indictment shall be forfeited from the accused.

The indictment charges Е. HINDIĆ to have illicitly traded in excise products i.e. coffee that was not labeled with control and tax stamps as regulated by the BiH Tax legislation.

The proposed sentence is in line with the role of the accused in commission of the criminal offense.

With this agreement the accused confirms that she is aware of the content of the Plea Agreement. She also confirms that the plea statement was given voluntarily, knowingly, with full understanding and undertakes to reimburse the costs of the criminal proceedings that may eventually be determined by the Court of BiH.

Pursuant to this agreement the accused has waived her right to a trial and appeal to the criminal sanction that shall be rendered to her by the Court of BiH.

The agreement was submitted to the Court of BiH.
