THE ACCUSED ANTE BAČIĆ (1972)) CONCLUDED A PLEA AGREEMENT

The accused Ante BAČIĆ concluded an Agreement on admission of guilt for the committed criminal offense of Impermissible Use of Copyrights under Article 243, Paragraph 1 of the Criminal Code of BiH.

The accused Ante BAČIĆ AKA ,,Toni“, born on August 17, 1972 in Dubrovnik - Republic of Croatia, residing in Neum, with prior convictions, citizen of BiH and the Republic of Croatia, entered into a plea agreement with the Prosecutor of Department III within the Prosecutor’s Office of BiH.

By virtue of signing the agreement the accused fully admitted committing the criminal offense he was charged with by the indictment of the Prosecutor’s Office of BiH issued on October 5, 2012 and confirmed by the Court of BiH on October 9, 2012.

Pursuant to the agreement the Prosecutor and the Defense agree that the accused Ante BAČIĆ be rendered a conditional eight (8) month imprisonment sentence by the Court of BiH which will not be executed providing that the accused does not commit another criminal offense during a two (2) year period following the final verdict, and that he be rendered a fine of 10.000,00 BAM as additional sentence.

The proposed sentence is in line with the role of the accused in commission of the criminal offense.

The accused Ante Bačić is charged to have driven a motor vehicle in the afternoon of September 19, 2012 at the border line of Neum municipality, transporting 200 illegally produced CDs containing copyrighted music well aware that those were illegally made copies.

With this agreement the accused confirms that he is aware of the content of the indictment issued by the BiH Prosecutor's Office. He also confirms that the plea statement was given voluntarily, knowingly, with full understanding and undertakes to reimburse the costs of the criminal proceedings in the amount that may eventually be determined by the Court of BiH.

Pursuant to this agreement the accused has waived his right to a trial and appeal to the criminal sanction that shall be rendered to him by the Court of BiH.

The agreement was submitted to the Court of BiH.
